Most Alabama mortgages carry a power-of-sale clause, and for mortgages executed after December 31, 1988, Title 35, Chapter 10, Article 1A sets the notice and sale procedure a lender follows without going to court. After the sale, Ala. Code § 6-5-248 gives a statutory right of redemption of 180 days from the sale for residential property on which a homestead exemption was claimed in the tax year of the sale, and one year from the sale for all other property. The debtor, the mortgagor, junior mortgagees, judgment creditors, and their respective transferees, spouses, children, heirs, or devisees may redeem.
